Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Lansan Connect website, including any related tools, agent partner portal, and referral pipeline features (collectively, the "Site"). The Site is owned and operated by The Lansan Company, LLC, a North Carolina limited liability company doing business as "Lansan Connect" ("Company," "we," "us," or "our"), located at 65 Glen Rd, Suite 382, Garner, NC 27529.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Description of Service

Lansan Connect is a real estate lead-generation and agent partner portal that allows visitors to submit property or buyer/seller interest information, and allows affiliated real estate agents and partners to access a referral pipeline for the purpose of managing client referrals. The Site does not itself provide brokerage services; any real estate brokerage services referenced or facilitated through the Site are performed by licensed real estate professionals and brokerages, including agents affiliated with eXp Realty or other licensed brokerages.

2. Eligibility

You must be at least 18 years old to use the Site. By using the Site, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. Accounts and Agent Portal Access

Certain features of the Site, including the agent partner portal, require an account or login credentials. If you are issued access:

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate, current information and to promptly update it as needed.
• We may suspend or terminate portal access at our discretion, including for misuse, inactivity, or breach of these Terms or any related partner agreement.

Agent partner access may also be governed by a separate written referral, reseller, or partner agreement, which controls in the event of a conflict with these Terms as to referral terms and compensation.

4. Lead Submissions and Referrals

If you submit contact information, property details, or buyer/seller interest through a form on the Site:

• You consent to being contacted by the Company, its affiliates, or referred licensed real estate agents regarding your inquiry, by phone, text, or email.
• Submitting information through the Site does not create a brokerage relationship, an attorney-client relationship, or any other professional relationship with the Company. Any such relationship is formed, if at all, directly with a licensed real estate agent or brokerage.
• Referral fees, where applicable, are handled in accordance with applicable North Carolina Real Estate Commission (NCREC) rules and are payable only to properly licensed individuals or entities.

5. No Brokerage or Legal/Financial Advice

Nothing on the Site constitutes real estate brokerage services, legal advice, financial advice, or a guarantee of any transaction outcome. Property information, market data, or comparative market analyses referenced through the Site are provided for general informational purposes and should be independently verified.

6. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law or regulation, including fair housing laws;
• Submit false, misleading, or fraudulent information;
• Attempt to gain unauthorized access to the Site, the agent portal, or any related systems or data;
• Scrape, harvest, or misuse any data, leads, or contact information obtained through the Site;
• Interfere with or disrupt the operation of the Site.

7. Intellectual Property

All content on the Site, including text, graphics, logos, the "Lansan" and "Lansan Connect" names and marks, software, and design elements, is owned by or licensed to the Company and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without prior written consent.

8. Third-Party Links and Services

The Site may link to or integrate with third-party services (for example, brokerage websites, MLS data providers, or scheduling tools). We do not control and are not responsible for the content, policies, or practices of third-party sites or services.

9. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PROPERTY OR MARKET INFORMATION IS ACCURATE OR CURRENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, OFFICERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SITE OR ANY TRANSACTION FACILITATED OR REFERENCED THROUGH THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless the Company, its owners, officers, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any applicable law.

12. Termination

We may suspend or terminate your access to the Site or the agent portal at any time, with or without notice, for any reason, including violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by a revised "Last Updated" date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.
